The court reviewed the defense's ex parte letter concerning materials for cross-examination of the Government's first witness. It found the attachments outside Rule 16's disclosure requirements as impeachment evidence, but nevertheless ordered production at the end of direct examination because the distinction from case-in-chief evidence was blurred.
